The Conservative Supreme Court Just Upheld Obamacare.

Let’s talk about why.

After the passing of Ruth Bader Ginsburg led to the Republicans ramming through yet another Supreme Court pick one week before the election, I’m sure many of us were grappling with the significance of the ramifications such a right wing supreme court on the country for decades to come. While we continue to process and see how this could affect everything from climate change legislation to voting rights, the court recently made a decision to uphold Obamacare that left many of us surprised. That is, until we look below the surface.

The 7–2 decision, with only Justice’s Alito and Gorsuch dissenting, was yet another blow to the right wing’s efforts to overturn Obamacare. But considering the fact that the Supreme court has a 6–3 majority, it’s interesting to consider why they seemingly find Obamacare so uncontroversial, and why the right is having so much trouble overturning it.

As much as liberals might hail it as the greatest accomplishment for Democrats in recent years while the right attempts to equate it to tyranny, the truth is Obamacare could not have been more of a capitulation to the right when it comes to healthcare if it tried. At a moment where the movement for single payer healthcare was intensifying and Barack Obama vowed to fight for a public option…
